    Introduction

     Like other States of the Sudan, the State of the grate Darfur enjoy a number of development projects in the different fields of development, some of which are financed through the national development budget, such as the Road of Al Ingaaz Al Gharbi (Western salvation road), the Martyr Sabrah Airport, Abu Jabrah railroad, Neiala and El-Obied transport line – Al Foulah, Neiala - Al Fasher. Other projects are funded from States’ development budget, such as the project of water harvest, the project of States internal routes, the project of the Marrah Mountain (Jabal Marrah)- Om Ajaj- Abu Fama and others.   - In May, 2006, the Abuja agreement accorded positive distinction to the Greater Darfur States, allocating $700 million (dollars) to development and reconstruction in addition to development of Darfur States to be implemented by the Darfur Regional Transitional Authority from 2007 – 2011, through the Darfur States development roadmap. - The Doha Document for Peace in Darfur (DDPD) was signed in July, 2001. Under DDPD, the government of the Sudan had to earmark $2 billion dollars for the development of the Darfur States in addition to the remittances set aside for it from the Commission on revenue allocation and oversight.In December, 2011, a Presidential Decree was issued to terminate the Transitional Authority and set up Darfur Regional Authority. Along the same lines, a ministerial decision No. 26 adopted to form a committee to take over the Transition Authority projects and deliver turn them over to Darfur Regional Authority.    
    • 2. Tasks and Mandate of the committee:
      1) Taking over the development projects for the transitional period in line with the actual Darfur Development Roadmap and delivering them to the Darfur Regional Authority (DRA).2) Designating hurdles and problems which hampered the implementation and how to address them.3) Specifying current contracts and banding commitments in terms of achievement.4) Proposing solutions to the problems of contractors and consultants.5) Elaborating a budget to run its proceedings with a view to accepting field projects and ascertaining the validity of their implementation in the framework of the takeover and transfer process between the Transitional Authority and the Regional Authority.6) Specifying the problems and obstacles that block the way of project implementation and how to address them.
    • 3. Committee’s Methodology of Work
      In fulfillment of its functions, the committee adopted the following methodology:• Holding of frequent meetings• Requesting reports from authorities responsible for monitoring the projects under implementation, provided these reports would be authenticated and signed by these authorities.• Reviewing the financial and quantitative performance of the executed projects to be delivered.• Taking stock of all the projects carried by the Transitional Authority, classifying them and specifying their locations on a geographical map.• Holding coordinating meetings and encounters with officials and relevant organs.• Elaborating a mechanism for field tuning over and acceptance of projects as follows:1. Constituting three sub-committees for (the States of North Darfur – East and South Darfur – Central and West Darfur) membership of which includes representatives of the following organs:-• Ministry of Finance and National Economy• Darfur Regional Authority• Darfur Transitional Authority• Economic Security• Commission for the allocation and monitoring of financial earnings• Representatives of relevant State ministries (water, health, education) and former Transitional authority in the States.2. Preparing turning over and acceptance of projects form with the signature of the committee’s members as a final document for the delivery and transfer process with the participation of relevant authorities.3. Undertaking field scrutiny of the implemented projects and documenting that process.
    • Following is an executive summary of the committee’s work:
      According to the development roadmap, the amounts set aside for the projects of the former Darfur Regional Transitional Authority totaling (LB 1.887.547.839) pounds, while there is a discrepancy in the different levels of project performance as it is made clear in the listings of the field turning over and acceptance of projects.Following are the approvals and actual disbursement over projects to be handed over:-
    • First: Projects of the Darfur Reconstruction and Development Fund:
      1Projects of the Arab Fund for Economic GrowthThese are projects in the domains of education, health and water with a grant totaling $8 million (dollars). The amount debited thereon is almost $6,167,161 and the total sum of local exchange reaches LB 1.047.383 pounds.2Projects of the Islamic Development Bank – JeddahThey include projects in the sphere of social services (education, health, water) funded by a loan from the Islamic Development bank – Jeddah to the tune of $10 million (dollars), 7.5 million dollars have been debited thereon and the remainder is around $2.5 million (dollars), at a time when local exchange totals LB 1.024.280 pounds.3Water Network Project for the three cities: Al Fasher-Neialla-Al Jeneinah-The contract to carry out the water network project for the three cities was signed on 27/4/2009 between Ministry of Finance and National Economy represented in the Darfur Reconstruction and Development Fund and the coalition of Cobalt and Al Nabetah firms with an amount of LB 247.1 million (pounds). It was agreed that the value of the contract will be reduced to LB 232.1 million (pounds).-the value of that contract will be paid off with financial bonds issued from Ministry of Finance and National Economy.-bonds totaling LB 208.8 million (pounds) were issued.-the ratio of actual implementation constitutes 41.2% of the total works; equivalent to LB 95.5Million (pounds) in the form of bonds, repayment of which was due by dint of certificates of completion in the course of 2010 – 2011 – 2012. They have not been paid off yet. However, work is underway on the projects and companies are demanding prices increase.4Project of the Transitional Authority building in Al Fasher:This project is to be financed through a loan (a benefit sharing contract) from the Saudi bank of Al Jazzera with an amount of $20 million (dollars), i.e. equal to 65 million Saudi Riyal to be carried out by the Zamel Saudi firm and safeguarded by the Arab Institution for Investments and Export Credit by virtue of a letter of guarantee issued from the Bank of Sudan containing the value of the loan.-the sum total of premiums paid off by the end of 2011 is $10.186.268.12 and the remaining balance of installments is $9,121,893.46
    • Cash backstop presented to projects already in existence in the States is as follows:
      1. Supporting Al Fasher University with an amount of LB 200,000 (pounds).2. Neialla University (LB 132,000).3. Zalingy University (LB 550,000). 4. Neialla Hospital (LB 100,000) for building a mortuary.5. Zalingy electricity (LB 100,000).6. Social and sports associations in Darfur (LB 100,000).7. Al Housh water purification station (LB 65,000).8. Neialla City water (LB 92,000)9. Bram City water (LB 160.000).10. Studies and research conduct at the Ajara water purification station (LB 24,600).11. Purchase of a GEOPHYSICS system (LB 45,000).
    • Second the Commission s projects for rehabilitation and resettlement
      The project of digging and installation of (358) integrated water purification stations:-A 73.7 million pound contract was signed between the rehabilitation and repatriation Commission of the former Transitional Authority and three other companies: (Tian Jeen, the Chinese drilling company – the Iranian Arsham Sakhtman Co. and Khalid Abdallah Al Sheikh Co.) to dig and install (358) water purification stations (turnkey) to resettle nomads in the Darfur States: Contractual transactions were as follows:-                    Total value of contractsNumber of wells30,637,800 145 8,543,000 138 14,535,000 75 73,715,800 358
      According to the payment plan developed by Ministry of Finance and National Economy, 30% of contractual costs i.e.the equivalency of LB 22,116,000 (pounds) in cash, would be paid off in advance. The remaining balance would be issued in bonds; 40% of which would be paid off in the course of 2009 and 30% during of 2010. Contractual upfront money was paid as follows:

      Since the Iranian Arsham company did not carry out any agreed Well works, the letter of guarantee was confiscated.
    • Third; Projects of the Darfur land commission
      1/ Project of land use roadmap and surveying natural resources in Darfur- The contract was signed between the Land Commission and the Kaffe German company in August, 2010 to execute the project in two years under the supervision of the consultative Interghraph company for Integrated Solutions.- The total cost of the project was almost 6.4 million Euros, 1.38 million Euros was paid by Ministry of Finance and National Economy.- Percentage of implementation reached around 60%. What wais required was to reschedule project execution and payment of dues owed to the executing company and the consultative firm in conformity with the provisions of the contract.2/Project of collecting customs, traditions and heritage related to the uses of Darfur land- The contract was signed by the commission and the National hub of experience (Beit Khebrah al-Watanyah) in August, 2008 to execute the project over two years.- The total cost of the project amounted to nearly LB 1,050,000.- Execution reached 80%. What was needed was to pay the dues of Beit Khebrah al-Watanyah.3/Project of Darfur’s borders in recent history (its historic dimensions and contemporary reality):-- The contract was signed by the commission and Beit Khebrah al-Watanyah in March, 2009 to execute the project in the course of two years- The total cost of the project amounted to LB 400.000 out of which LB 300.000 were paid off.- Implementation reached 95%. The final printing of the study is presently underway. It is required that dues be paid to the expert as well as printing costs.4/study of historical development of land systems and the administration of tribal protectorates (certain areas traditionally monopolized by certain tribes which allow no transgression thereon) in Darfur- The contract was signed in October, 2010 by the commission and Beit Khebrah al-Watanyah to execute the project in two years to the tune of LB 300.000 out of which an amount of LB 200.000 was repaid. - Implementation ratio reached 90%.- The project is in the final review stage. There is need to pay the dues of the expert and revision.5/project of enlightenment and raising awareness as to the intellectual framework of the Darfur land commission- The project consists of holding specialized workshops in the States of Darfur with a view to raising the awareness of citizens and enlightening them to the commission’s intellectual framework.- LB 500,000 were paid to execute the project.- Execution was 100%.6/constructing a lab for the area and the equipment- Field and lab devices and equipment were purchased at a price of LB 1.915.851.- Cadastral devices and equipment were placed inside the commission lab in Khartoum.- Execution was 100%5.     • General Observations:
            Through field trips and awareness of the Implemented projects, it is clear:    1- Projects funded through grants and loans were executed with high competency.    2- Coordination between specialized State administrations and project administration in the States had a considerable positive impact on the success of the projects undertaken by Darfur Reconstruction and Development Fund of the Transitional Authority.    3- Non-participation by certain State units in overseeing projects underway in some States had adverse effect. For example, this is evident in some projects run by Rehabilitation and Repatriation Commission of the previous Transitional Authority in the State of West Darfur.      4- It is necessary to follow up and assess development projects through field visits and setting a budget aside for them.    5- Darfur Land Commission’s projects are contractual in nature. Therefore, they were not delivered on the ground.    6- Darfur’s lack of infrastructure and qualified human cadres constituted a considerable barrier to implementation of the development projects.   
    • 7.    Recommendations:
            There is a need for:  1- Undertaking full coordination between project executing administration in the States and relevant organs.  2- A continuous follow up and evaluation of projects through field visits and report submission.      3- Representation of States in the process of project follow up and oversight through their representation in the Governing Councils and Steering Committees of these projects.      4- continuing to complete water purification networks in the three cities (Al Fasher, Neialla and Al Jeneinah) by the consortium of Cobalt and Al Nabetah Engineering firms as well as the Consultative Viking Co. (Viking for consultation), addressing the debt owed to the executing company for the executed works due for payment by virtue of completion certificates which are funded by development bonds.      5- focusing on extending integrated, basic and necessary services to the voluntary repatriation villages so that they will attract internally displaced persons (IDP’s) and refugees.      6- rewarding those cooperating with Darfur Reconstruction and Development Fund for the period January – June 2012 and those cooperating with Rehabilitation and Repatriation Commission for the period January – March, 2012.      7- expediting the installation of the 12 drilled wells in the two States of Central and North Darfur, executed by Khalid Abdallah Al Sheikh Co., eight of which are located in the State of Central Darfur and four in the State of North Darfur.      8- attempting to speedily handle faltering projects in general by focusing on the of project of digging and installing 358 wells and trying to reach a settlement with the Chinese Tian Jeen Co. in regards to executed works as well as with Khalid Abdallah Al Sheikh Co. in addition to treating the dues owed to the Consultative company.      9- continuing the completion of Darfur Land Commission’s projects and tackling the dues owed to executing and monitoring companies and national hubs of experience.      10- continuing the construction of the Regional Authority Headquarters’ building in Al Fasher with the same specifications and business partners and trying to benefit from the cyclical loan (benefit sharing), utilizing its upper ceiling of $100 million.      11- conducting and adopting feasibility study for each project intended to be implemented in anticipation of rewarding quick gain which will be conducive to treating the root causes of the problems in Darfur.      12- constituting a committee responsible for receiving the dossiers and documents relating to the development projects of former Darfur Transitional Authority.      8- Conclusion      The committee wishes to extend its warmest thanks and gratitude to the Darfur former Transitional Authority, state governments and security apparatus for their contribution to the success of the turn over and consent to projects process and for enabling the committee to perform its task adequately.      May God grant us success             Members of the Committee:-      1.    Assem Hamza Hussein    Ministry of Finance and National Economy    Chairperson      2.    Ibraheem Hamed Adam    North Darfur State                Member      3.    Mohamed Tejani Al Tayeb    Darfur Reconstruction Fund            Member      4.    Mohamed Al Zein Al Nour    South Darfur State                Member      5.    Mai Musa K. After negotiation with the company, a $12.5 million (dollars) was agreed.            Abu Jabrah – Neiala railroad      -    This project represents phase II of the Neiala – Babnousah. It is carried out by Khartoum Irrigation Ltd. Co. It is 215 kms long and it costs $284 million (dollar). A guarantee letter containing the amount was issued in Sept. 2011. No execution took place. Finance terms were adjusted by the company for payment to commence in 2015.      -    A $5 million (dollar) amount was approved in the 2012 budget for the local components of Babnousah-Abu Jabrah- Neiala.            transit line of El-Obied -Al Foulah- Babnousah      -    It is a transmittal electric line.
